NOTICE OF FORECLOSURE SALE UNDER POWER MCDUFFIE COUNTY, GEORGIA Under and by virtue of the Power of Sale contained in a Security Deed given by Walter Hayes and Elizabeth F. Hayes to United States Of America, acting through the Farmers Home Administration, United States Department of Agriculture, dated January 27, 1989, and recorded in Deed Book 154, Page 868, McDuffie County, Georgia Records, conveying the after-described property to secure a Note in the original principal amount of Forty-Three Thousand and 0/100 dollars ($43,000.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of McDuffie County, Georgia, within the legal hours of sale on March 3, 2020, the following described property: ALL that lot or parcel of land, with improvements thereon, situate, lying and being in the City of Thomson, 134th District G.M. of McDuffie County, Georgia, containing 0.23 acre and being identified and designated as Lot No. 17, Block D of and in McNeill-Usry Subdivision and being more particularly described as follows: Beginning at a point on the southern edge of the right-of-way of Matthew Street which point is located at distance of 329.78 feet in a easterly direction from the intersection of the southern edge of the right-of-way of Matthew Street with the eastern edge of the right-of-way of Matthew Street as it turns in a southerly direction and from said point proceeding along the southern edge of the right-of-way of Matthew Street North 70° 45' 25" East for a distance of 80.09 feet to a point; thence proceeding South 18° 40' 29" East for a distance of 125.31 feet to a point; thence proceeding South 70° 46' 25" West for a distance of 80.05 feet to a point; thence proceeding North 18° 41' 34" West for a distance of 125.29 feet to the point of beginning. Said property is bounded: On the North by Matthew Street; on the East by property of Harris and Hilton; and on the South and West by McNeill-Usry Subdivision and is more particularly described by Plat of Survey thereof prepared by John A. McGill, R.L.S. No. 1753, dated April 19, 1988, copy of which is recorded in Plat Record R, page 2E, McDuffie County Clerk's office. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorney’s fees (notice of intent to collect attorney’s fees having been given). The entity having full authority to negotiate, amend or modify all terms of the loan (although not required by law to do so) is: USDA, Rural Development they can be contacted at (800) 349-5097 x 4500 for Loss Mitigation Dept, or by writing to 1400 Independence Ave, SW, Procurement Management Division, Washington, District of Columbia 20250, to discuss possible alternatives to avoid foreclosure. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. To the best knowledge and belief of the undersigned, the party in possession of the property is The Estate of Elizabeth F. Hayes and The Estate of Walter Hayes or tenant(s); and said property is more commonly known as 711 Matthews St, Thomson, GA 30824. The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code (2) final confirmation and audit of the status of the loan with the holder of the security deed and (3) any right of redemption or other lien not extinguished by foreclosure.
